Rival Air Taxi Firms Accuse Each Other of Design Plagiarism

Archer Aviation files complaint against Vertical Aerospace, alleging patent infringement on air taxi designs. Heated rivalry emerges in the competitive urban air mobility market.
Archer Aviation has filed a complaint in the US District Court Eastern District of Texas, accusing rival firm Vertical Aerospace of copying its "Midnight" air taxi design for Vertical's own "Valo" vehicle. Archer is seeking to block Vertical from using the allegedly copied designs, as well as several other patents the company claims have been infringed upon.
"Vertical has knowingly, willfully, and in reckless disregard leveraged and exploited the significant investments Archer has made in its proprietary technology," Archer said in its complaint. The two air taxi designs certainly appear strikingly similar, leading Archer to allege that Vertical has "systematically and pervasively copied Archer's core technological innovations and design elements."

The legal battle highlights the intensely competitive nature of the urban air mobility (UAM) market, as startups race to develop the first commercially viable electric vertical take-off and landing (eVTOL) aircraft. Both Archer and Vertical are aiming to bring their air taxi models to market in the next few years, positioning themselves as leaders in the emerging eVTOL industry.
Archer, based in the San Francisco Bay Area, has raised over $1 billion in funding and is backed by major investors like United Airlines and Stellantis. Vertical, headquartered in the UK, went public in 2021 through a SPAC deal and has secured pre-orders from airlines like American and Virgin Atlantic. The two companies have emerged as fierce rivals in the race to certification and commercialization of their respective air taxi designs.

The patent infringement allegations underscore the high stakes involved, as these startups vie to establish dominance and claim a significant share of the anticipated $1 trillion global UAM market. With billions of dollars in investment and high-profile airline partnerships at play, the battle between Archer and Vertical is sure to intensify in the coming years as the eVTOL industry takes flight.

As the competitive landscape heats up, the outcome of this legal dispute could have far-reaching implications for the future leadership and direction of the emerging urban air mobility sector. The rivalry between Archer and Vertical is emblematic of the broader challenges and opportunities facing this rapidly evolving industry.
