Court Blocks Eviction of Homeless Encampment in Brisbane Park

Queensland Supreme Court rules that a council's removal of a homeless camp in a local park violated human rights laws, preventing further evictions.
In a landmark ruling, the Queensland Supreme Court has determined that the City of Moreton Bay's attempt to clear a homeless encampment from Goodfellows Road Park in the suburb of Kallangur was a violation of human rights. The court sided with a group of 11 residents who had challenged the eviction notices issued against them by the local council.
Homeless Residents File Successful Legal Challenge
The case arose last year when the City of Moreton Bay sought to remove the tent city that had formed in Goodfellows Road Park, citing concerns over public health and safety. However, the group of homeless individuals living in the park filed a legal challenge, arguing that the proposed eviction would infringe on their fundamental human rights.
After hearing the evidence, the Queensland Supreme Court ruled in favor of the homeless residents, blocking the council from proceeding with the encampment's removal. The court determined that the council's actions had breached the individuals' human rights, effectively denying them access to adequate shelter and support services.
