Idaho Seeks to Criminalize Trans Bathroom Use in Private Businesses

A new Idaho bill aims to punish transgender individuals for using bathrooms that match their gender identity, even in privately owned businesses.
In a concerning move, Idaho lawmakers are considering a bill that would make it a criminal offense for transgender people to use bathrooms that align with their gender identity, even within privately owned businesses. This proposed legislation is the latest in a string of measures across the United States that target the transgender community for simply living their lives.
Bathroom Bills on the Rise
At least 19 states, including Idaho, already have laws in place that restrict transgender individuals from using bathrooms and changing rooms that match their gender identity in schools and, in some cases, other public spaces. And now, three additional states – Florida, Kansas, and Utah – have gone a step further by making it a criminal offense to violate these bathroom laws in certain circumstances.

The LGBTQ+ advocacy organization Movement Advancement Project has been closely tracking the proliferation of these discriminatory laws, which serve to marginalize and stigmatize transgender people for simply using the restroom. By expanding these restrictions to include private businesses, the proposed Idaho bill represents a concerning escalation in the ongoing assault on transgender rights.
Undermining Privacy and Dignity
Proponents of the Idaho bill argue that it is necessary to protect the privacy and safety of cisgender individuals.
