NSW Anti-Protest Law Challenged: Constitutional Clash and Social Cohesion Concerns

Lawyers argue that the Minns government's sweeping protest restrictions in NSW have undermined its own objectives, with a constitutional challenge underway in the state's court of appeal.
Lawyers representing three protest groups have argued that a Minns government law, which effectively banned marches in Sydney's CBD, has actually made its own objective of enhancing social cohesion worse. The constitutional challenge against the anti-protest law was heard on Thursday in the NSW Court of Appeal, with the law being passed in the wake of the Bondi terror incident.
The lawyers contend that the state needs to prove it was 'rational to prevent all protests' in order to achieve social cohesion, a claim they argue the government has failed to substantiate. This marks a significant legal battle over the scope and legality of the controversial protest restrictions introduced by the Minns administration.
